Lawsuit for Non-Implementation of the Law on Tobacco Control and Human Rights Violations

The Center for Strategic Judicial Cases (CSL) has sent to the Basic Court in Prishtina a Lawsuit for Non-implementation of the Law on Tobacco Control and Human Rights Violations against the Ministry of Health and the Office of the Prime Minister of Kosovo.
This is the second strategic case sent by the Center for Strategic Judicial Cases which deals with the violation of the fundamental right of citizens to life and health by public institutions in Kosovo.
The Law on Tobacco Control stipulates that smoking is prohibited in closed public places such as service premises, which have a movable roof or not, and which are surrounded by two or more sides, regardless of the material of the use and whether the structure is permanent or temporary.
Therefore, the failure of public institutions in Kosovo to implement the Law on Tobacco is a violation of the fundamental rights of citizens in life and health.
The Service Area of the Center includes only cases where the public institutions in Kosovo violated citizens’ rights.
